MEMORIAL CUP TRIVIA CONTEST

NO PURCHASE IS NECESSARY TO ENTER THIS CONTEST. ODDS OF WINNING DEPEND UPON THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED. A TICKET PURCHASE/PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. SKILL TESTING QUESTION REQUIRED TO WIN.

THIS CONTEST IS OPEN ONLY TO RESIDENTS OF CANADA, EXCLUDING QUEBEC, AND IS GOVERNED BY CANADIAN LAW.

1. KEY DATES.

The “Memorial Cup Trivia” (the “Contest”) begins on May 26, 2023 at 9:00 p.m. ET (the “Contest Start Date”) and ends on June 4, 2023 at 11:59 p.m. ET (the “Contest End Date”) (such period referred to herein as the “Contest Entry Period”). All times are measured by Eastern Time (“ET”) in Canada.

2. SPONSOR:

The Contest is sponsored by the Canadian Hockey League. (the “Sponsor”).

3. ELIGIBILITY:

The Contest is only open to legal residents of Canada, excluding Quebec, who have reached the legal age of majority in their province/territory of residence at the time of entry, except for employees, representatives, agents (and their immediate family member and persons living in the same household, whether related or not) of Sponsor, the Canadian Hockey League, as contest administrator (the “Administrator”), and/or each of their respective affiliates, subsidiaries, member clubs (for the Administrator), prize suppliers, dealers, advertising/promotion agencies and any other individual(s) or entity(ies) involved in the development, production, implementation, administration or fulfillment of the Contest (collectively, the “Contest Parties”).

4. AGREEMENT TO BE LEGALLY BOUND BY RULES:

By participating in the Contest, each participant unconditionally accepts and agrees to comply with and abide by the terms and conditions stated in these rules (the “Official Rules”) which shall be final and binding in all respects, agrees to be bound by the decisions of Sponsor, and warrants that she/he is eligible to participate in the Contest.

5. FACEBOOK, TWITTER, INSTAGRAM NOT INVOLVED:

This Contest is in no way sponsored, endorsed or administered by, or associated with Facebook, Inc., Twitter, Inc. or Instagram, Inc. Any questions, comments or complaints must be directed to the Sponsor or Administrator, and not to Instagram, Inc., Twitter Inc. or Facebook, Inc.

6. HOW TO ENTER:
7. Entrants may enter the Contest by downloading the CHL Official App (the “Contest App“) during the Contest Entry Period and by following and completing the on-screen prompts, each an “Entry” or the “Entries”). If it is discovered by the Sponsor or Administrator (using any evidence or other information made available to them) that any person has attempted to use any automated, macro, script, robotic or other system(s) or program(s), and/or any other means not in keeping with the Sponsor’s interpretation of the letter and spirit of these Official Rules to enter using the Free Method of Entry or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor or the Administrator.

 

1. For each entry method, you will also have the option to opt-in to receive information and promotional offers from the Sponsor and/or Administrator. If you choose to opt-in, your consent can be withdrawn at any time after you have been contacted. For clarity, consent to an opt-in is not required to enter the Contest and does not impact your odds of winning.

 

1. The Contest Parties and each of their respective agents, employees, directors, officers, shareholders, successors and assigns (collectively, the “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, delayed, lost, intercepted, misdirected, unintelligible, incomplete or incompatible Entries and/or Essays (all of which are void).

 

1. An Entry may be rejected if, in the sole and absolute discretion of the Sponsor, the Entry is not submitted and received in accordance with these Official Rules during the Contest Period.

 

 

7. VERIFICATION:

 

All Entries and entrants are subject to verification at any time and for any reason.  The Sponsor and/or the Administrator reserves the right, in their sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor and/or the Administrator – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry and/or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the Sponsor’s interpretation of the letter and spirit of these Rules.  Failure to provide such proof to the complete satisfaction of the Sponsor and/or the Administrator within the timeline specified by the Sponsor and/or the Administrator may result in disqualification in the sole and absolute discretion of the Sponsor.  In the event of a dispute as to the identity of an entrant, an entry will be deemed submitted by the authorized account holder of the e-mail account provided to the Sponsor and/or the Administrator at the time of entry. The authorized account holder shall be the natural person to whom the applicable email address has been assigned by the Internet access provider, service provider, or other online organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.  The sole determinant of the time for the purposes of this Contest will be the official time-keeping device(s) of the Sponsor and/or the Administrator.

 

8. SUBMISSION REQUIREMENTS:

 

BY SUBMITTING AN ENTRY, YOU AGREE THAT THE ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE ESSAY) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF YOUR ENTRY (OR ANY COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE ESSAY); (II) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (Iii) IF DECLARED A WINNER, THE PRIZE (INCLUDING ANY USE OR MISUSE OF THE PRIZE).  THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE OFFICIAL RULES. THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF THE PRIZES.

 

By participating in the Contest, each entrant hereby warrants and represents that any entry materials he/she submits:

 

1. is/are original to him/her and that the entrant has obtained all necessary rights in and to the entry materials for the purposes of entering such entry materials in the Contest;
2. does not violate any law, statute, ordinance or regulation;
3. does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence;
4. will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party; and
5. is/are not defamatory, trade libelous, pornographic or obscene, and/or otherwise are or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.

The Sponsor and/or the Administrator (the “Reviewer”) reserves the right to screen all entry materials.   Any entry materials that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Official Rules are subject to disqualification.

9. PRIZES AND ELIGIBLE WINNER SELECTION PROCESS:

There will be a total of nine (9) prizes (the “Prize”) available to be won in this Contest as follows:

• Nine (9) CHL Prize packs, valued at $150 each

Prize: On June 5th, 2023 at approximately 11:00 a.m. ET in Toronto, Ontario, the Administrator will select one (1) Prize winners by random draw from the entire pool of entrants whose entries were submitted and received by the Administrator before the Contest End Date.

The random draws for this Contest will be performed using a random number generator algorithm.

The following general conditions apply to all Prizes: (i) the Prizes must be accepted as awarded and is not transferable, assignable and/or convertible to cash (where applicable) (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted, except at Sponsor’s discretion; (iii) the costs of everything not specifically and expressly stated above as included in each Prize are the sole and absolute responsibility of the confirmed winner; (iv) Sponsor reserves the right at any time, where applicable, to substitute the Prizes for any reason with a prize of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (v) all federal and/or provincial tax liabilities as a result of acceptance of any Prize are the sole responsibility of the winners; (vi) Sponsor is not responsible for a winner’s loss or the theft of a Prize, or any portion thereof; and (vii) by accepting a Prize, each confirmed winner agrees to waive all recourse against the Released Parties if the Prize does not prove satisfactory, either in whole or in par.

None of the Released Parties makes any representation or offers any warranty, express or implied, as to the quality or fitness of the Prizes awarded in connection with the Contest. To the fullest extent permitted by applicable law, the confirmed winners understand and acknowledge that they may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor, the Administrator or any of the other Released Parties should their Prize fail to be fit for its purpose or is in any way unsatisfactory.  For greater certainty and the avoidance of any doubt, by accepting the Prizes, the confirmed winners agree to waive all recourse against Sponsor, the Administrator and all of the other Released Parties if their Prize does not prove satisfactory, either in whole or in part.

10. ODDS OF WINNING:

The odds of winning any of the Prizes depend on the total number of eligible entries received at the time of the draw and/or received during the Contest Entry Period. There is no limit to the number of entries the Sponsor or Administrator may receive.

11. ELIGIBLE WINNER NOTIFICATION PROCESS:

The Sponsor and/or the Administrator will make a minimum of three (3) attempts to contact each eligible winner by the CHL Mobile app, email or telephone within five (5) business days of each selection as noted in Section 9 above.  If the eligible winner cannot be contacted as outlined above, or if there is a return of any notification as undeliverable, or if the eligible winner fails to provide the necessary information to confirm the his or her identity and eligibility to receive the Prize; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant for such Prize from among the remaining eligible entries submitted and received in accordance with these Official Rules in accordance with the procedures outlined in Section 9 (in which case the foregoing provisions of this section shall apply to such newly selected eligible Prize winner).

12. ELIGIBLE WINNER CONFIRMATION PROCESS:

NO ONE IS A WINNER UNLESS AND UNTIL THE SPONSOR AND/OR ADMINISTRATOR OFFICIALLY CONFIRMS HIM/HER AS THE WINNER IN ACCORDANCE WITH THESE RULES.  BEFORE BEING DECLARED AS A CONFIRMED PRIZE WINNER, the eligible winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor and/or the Administrator, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s and/or the Administrator’s form of declaration and release); and (b) sign and return within five (5) business days of notification the Sponsor’s and/or the Administrator’s declaration and release form, which (among other things): (i) confirms compliance with these Official Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Released Parties from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; (iv) agrees to indemnify the Released Parties against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her entry materials, or any portion(s) thereof; and (v) agrees to the publication, reproduction and/or other use of his/her name, city and province or territory of residence, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor and/or the Administrator in any manner or medium whatsoever, including print, broadcast or the internet.  If the eligible winner: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; (c) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor and/or the Administrator in their sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor and/or the Administrator reserves the right, in their sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant for the Prize from among the remaining eligible Entries submitted and received in accordance with these Rules in accordance with the procedures outlined in Section 10 (in which case the foregoing provisions of this section shall apply to such newly selected eligible Prize winner).

13. GENERAL CONDITIONS:

This Contest is subject to all applicable federal, provincial and municipal laws.  The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.  ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.

The Released Parties will not be liable for: (i) any failure of any website or any platform during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry, entry materials and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; (v) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; (vi) if a Prize cannot be awarded due to delays and/or interruptions due to Acts of God, natural disasters, terrorism, pandemics, weather and/or any other similar event beyond Sponsor an/or Administrator’s reasonable control; (vii) any damages, injuries and/or losses of any kind caused by and/or resulting from awarding, acceptance, possession, use, misuse, loss and/or misdirection of any Prize and/or resulting from participating in this Contest; and/or (viii) any combination of the above.

The Sponsor reserves the right to withdraw, amend or suspend this Contest (or to amend these Official Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Official Rules, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever.  Any attempt to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.  The Sponsor reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.  The Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.  In the event the Contest is cancelled, all entries into the Contest will be deemed null and void, all payments will be refunded, no winners will be selected and no Prizes will be delivered.

Privacy: In order to participate in the Contest, entrants will be required to supply certain information about themselves on the Contest Website entry pages or when submitting a Free Method Entry. By entering this Contest, each entrant expressly consents to the Sponsor and/or the Administrator, its agents and/or representatives, storing, sharing and using the personal information submitted for the purpose of administering the Contest and in accordance with the Sponsor’s and/or the Administrator’s privacy policy (respectively available at: https://chl.ca/privacy_policy. This section does not limit any other consent(s) that an individual may provide the Sponsor, the Administrators or others in relation to the collection, use and/or disclosure of their personal information.

Intellectual Property:  The Sponsor’s and the Administrator’s and its member clubs’ logos and trademarks are the property of each respective party. Any other trademarks referenced or used in these Official Rules are used for prize identification purposes only and are the properties of their respective owners. By entering the Contest, you are not granted and may not use any logos and trademarks described herein. All Contest materials are the property of the Sponsor and/or the Administrator and may not be copied, reproduced or used for any purpose without Sponsor’s and/or Administrator’s express prior written consent.

Governing Laws: The Contest and these Official Rules shall be subject to and governed by the laws of the Province of Ontario and the federal laws applicable therein. The Contest is void where prohibited and/or restricted by law and is subject to applicable federal, provincial, and municipal laws and regulations.

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

The failure of Sponsor to enforce at any time any provision of the Official Rules shall not be considered a waiver of such provision or any other provision and shall not deprive Sponsor of the right thereafter to enforce such provision or any other provision.
