1) SPONSOR: This Contest is organized by the Quebec Major Junior Hockey League (hereinafter the “QMJHL”) in collaboration with Conagra Food Service (hereinafter the “Sponsor”).
2) CONTEST PERIOD: This Contest begins on October 1, 2023, at 8:00 a.m. ET and ends on October 15, 2023, at 11:00 p.m. ET (the “Contest Closing Date”) (collectively, the “Contest Period”).
3) HOW TO ENTER: NO PURCHASE NECESSARY. To enter the Contest, visit the QMJHL’s official social networks (FACEBOOK or TWITTER) to:
- a) Comment under one of the contest publications on your favourite condiment to accompany your Pogos
- b) Use the #Pogos hashtag in the same comment.
All posts must be made before the end of the contest period. No messages or correspondence will be exchanged with contest participants, with the exception of those selected for a prize.
Limit of one (1) entry per residential address during the contest period. In the event multiple entries are received, only the first eligible entry will be considered.
The Sponsor and the QMJHL reserve the right, at their sole discretion, to reject any entry that they deem to be in violation of these Contest Rules.
The Sponsor and the QMJHL assume no responsibility for any claims of infringement relating to any entry submitted. By entering this Contest, each participant (i) declares that such entry does not infringe the copyrights, trademarks or other intellectual property rights of any third party (ii) agrees to release, indemnify, discharge and hold harmless the Promotion Parties, their respective parent, subsidiaries and affiliates, and their respective officers, directors, employees, agents and representatives from and against any and all claims or liability arising out of or in connection with the submission of the entry and participation in this Contest (iii) grants the Sponsor and the QMJHL an unlimited, royalty-free, irrevocable right and license to edit, modify, reproduce, display and/or distribute the entry in any form of media now known or hereafter developed, including, without limitation, as contemplated by these Official Rules, and in any advertising or promotion created by the Sponsor and the QMJHL in any form of media to promote this Contest and/or future contests similar to this Contest; and (iv) waives all moral rights in the Entry in favour of the Sponsor and the QMJHL.
The Sponsor and the QMJHL further reserve the right, at their sole discretion, to edit any entry to remove any trademark or copyrighted content. Entries that do not comply with the specific requirements will be disqualified.
4) ELIGIBILITY: The contest is open to legal residents of Quebec, Nova Scotia, New Brunswick, and Prince Edward Island who are 14 years of age or older on the contest closing date.
Employees, officers, directors, agents, or representatives of the Sponsor and the QMJHL, the Prize Provider, their respective affiliated or related companies, subsidiaries, advertising, and promotional agencies (collectively, the “Promotion Parties”), are not eligible to participate in this contest.
5) POTENTIAL WINNER SELECTION: There will be one (1) selection round and five (5) winners. Winners will be randomly selected by the Sponsor and the QMJHL from all eligible entries among those who mention a condiment and share the phrase #Pogos during the Contest Period.
The five (5) selections will take place on October 19, 2023, at 10:00 a.m. ET, from among all eligible entries received by the contest closing date. Before being officially declared winners, potential winners (or the participant’s parent/legal guardian) will be required to correctly answer a mathematical skill-testing question, without assistance or any mechanical or electronic aid. They will also be required to sign a standard declaration and release form confirming compliance with the official contest rules and acceptance of the prize awarded. Potential winners selected at random will be notified via social platforms no later than 5:00 p.m. ET on October 20, 2023. If potential winners cannot be reached by October 23, 2023, at 5:00 p.m. ET, an alternate winner may be selected at the discretion of the QMJHL and the Sponsor.
6) ODDS OF WINNING: Odds of being selected as a potential winner depend on the number of eligible comments containing the #Pogos hashtag.
7) PRIZES AND APPROXIMATE RETAIL VALUES (ARV): There will be a total of five (5) prizes available to be won during the Contest Period, consisting of five (5) boxes of twenty (20) pogos per winner. Each prize has an approximate retail value of $72.35.
Total approximate retail value of prizes is $361.75.
The approximate retail value of the prize is as indicated by the prize supplier thirty (30) days prior to the start of the Contest.
8) DECLARATION AND RELEASE: Potential winners will be required to sign and return a Declaration and Release Form within seven (7) days of the date indicated in the accompanying prize notification letter and attempted delivery, failing which the prize will be forfeited and may be awarded to another participant.
Return of a prize, undeliverable prize notification or noncompliance with the terms and conditions of these Official Rules may result in the exclusion of the participant and the selection of another participant, at the discretion of the Sponsor and the QMJHL.
9) LIMITATION OF LIABILITY: By entering the Contest, the participant accepts these official Rules and the decisions of the Sponsor and the QMJHL, which shall be final in all matters. By accepting the prize, the winner agrees to indemnify and hold harmless the Sponsor and the QMJHL, its affiliates, directors, officers, colleagues, right holders and related companies, licensors, licensees and assigns from and against any and all claims and liabilities arising out of the acceptance, use, misuse or redemption of a prize or participation in the Contest. The Sponsor and the QMJHL assume no liability or obligation for lost, late, incomprehensible, illegible, falsified, damaged, misdirected or incomplete entries, notices or responses, whether due to the foregoing or otherwise, or any typographical errors, technical problems, interruptions, deletions, defects, delay in operation or transmission, any failure, congestion or malfunction of any computer, Internet, software, telephones, cellular phones or computer equipment which may occur, by reason of any combination of the foregoing, including but not limited to malfunctions which may affect the transmission or non-transmission of an entry. The Sponsor and the QMJHL are not liable for incorrect or inaccurate information, whether caused by website or mobile application users, equipment, contest programming, technical or human error or any other error or omission. The Sponsor and the QMJHL are not liable for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, or alteration of, or unauthorized access to, entries. The Sponsor and the QMJHL are not liable for any injury or damage to the participant or to any computer or cell phone related to or resulting from participating or downloading materials or entries in the Contest. The Sponsor and the QMJHL do not assume any liability in the event that the Contest is not capable of running as planned for any reason whatsoever, including reasons beyond its control, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause that may affect the administration, security, impartiality, integrity or proper play of this Contest or the Contest Website.
The Sponsor and the QMJHL reserve the right to disqualify any participant who: a) violates these official Rules or the general rules/guidelines of any Sponsor or QMJHL property or online service; b) participates in the Contest in any manner which is contrary to these Rules or which would be unfair to other participants, or where entries are generated by any automated or mechanical means; c) acts in a disloyal or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Entry materials that have been altered, reproduced, falsified, or tampered with are void.
Any attempt to deliberately damage the operation of the Contest may be a violation of civil and criminal laws. In the event of such an attempt, the Sponsor and the QMJHL reserve the right to seek remedies and damages to the fullest extent permitted by law.
Unless otherwise specified, currency is the Canadian dollar. Each prize must be accepted “as is” and cannot be exchanged for cash, bartered, sold, substituted, transferred, or raffled, and is non-refundable. If the advertised prize is unavailable for reasons beyond the control of the Sponsor or the QMJHL, an alternate prize may be awarded.
Refusal to accept a prize releases the Sponsor and the QMJHL, the supplier of the prize, as well as its directors, officers, and colleagues, from all responsibilities and obligations towards the winner of such prize. The Sponsor and the QMJHL are under no obligation to award more prizes than are mentioned in these rules or to award prizes other than in accordance with these rules.
The Sponsor is in no way liable for the conduct of the Contest, which is entirely the responsibility of the QMJHL. The Sponsor is therefore not responsible for, and cannot be held liable for, any issues relating to the conduct of the Contest, the awarding of prizes or the prize itself.
10) ENTRY CONDITIONS: By accepting a prize, winners authorize the Sponsor and the QMJHL to use their name, city and province/territory of residence and likeness for publicity purposes in all media now or hereafter devised, throughout the world and in perpetuity, without further consideration, notification or permission, except where prohibited by law.
All information requested and provided by each participant must be true and accurate, and not misleading in any way. The Sponsor and the QMJHL reserve the right to disqualify any participant from the Contest at its discretion, if the participant at any time provides false, inaccurate, or confusing details or information, or if the participant is ineligible to participate in the Contest under these Contest Rules.
11) INTELLECTUAL PROPERTY: Intellectual property, including but not limited to trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans, and statements, belongs to the Sponsor and the QMJHL or their affiliates. All rights reserved. The unauthorized copying or use of any copyrighted resource or intellectual property without the express written permission of its owner is strictly prohibited.
12) INDEMNIFICATION: Participant releases the Sponsor and the QMJHL from any and all liability for any injury, loss or damage whatsoever suffered by the Participant or any other person, including but not limited to bodily injury, death or property damage, resulting in whole or in part, directly or indirectly, from participation in the Contest, any breach of the Rules or any Prize-related activity. The participant agrees to fully indemnify and hold harmless the Sponsor and the QMJHL from and against any and all claims by third parties in connection with the Contest.
13) REVOCATION: If, in the opinion of the Sponsor or the QMJHL, there is actual or suspected evidence of tampering with any portion of the Contest, or if technical difficulties or any other factor, including accident, printing or administrative error or mistake of any kind, compromise the integrity, administration or operation of the Contest, the Sponsor and the QMJHL reserve the right, with the consent of the Régie des alcools, des courses et des jeux du Québec and at its sole discretion, to modify, suspend or terminate the Contest, in whole or in part, at any time, without notice or obligation. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor and the QMJHL reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
14) PROVINCE OF QUEBEC: Any litigation respecting the conduct or organization of the Contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize in connection with the Contest may be submitted to the Régie only for the purpose of helping the parties reach a fair settlement.
15) PROTECTION OF PRIVACY AND USE OF PERSONAL INFORMATION: The Sponsor and the QMJHL respect your right to privacy. By entering the Contest, you: i) grant the Sponsor and the QMJHL the right to use your name, mailing address, telephone number, e-mail address, screen name or platform username (“Personal Information”) for the purposes of administering this Contest and conducting a publicity campaign in connection with the Contest; (ii) grant the Sponsor and the QMJHL the right to use your Personal Information for advertising and promotional purposes in connection with the Contest, in any and all media now known or hereafter devised, without further consideration, except where prohibited by law; (iii) acknowledge that the Sponsor and the QMJHL may disclose your Personal Information to third-party service providers or its agents in connection with any of the activities referred to in (i) and (ii) above. The Sponsor and the QMJHL will use the Participant’s personal information only for the Identified Purposes and only if the Participant consents at the time of participation to being notified of future promotions or contests of the Sponsor and the QMJHL. You may revoke your consent at any time. If you revoke your consent, your participation in this contest is null and void.
16) LEGISLATION: In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and the information or other statements contained in any material relating to this Contest, the terms and conditions of these Rules shall prevail and govern and control the Contest to the fullest extent permitted by law.
Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
17) OFFICIAL RULES: These rules will be available online at www.lhjmq.qc.ca as soon as the contest is launched on October 1, 2023.
